Colorado Springs Utilities' Home Improvement Financing Program is available to customers for the purpose of financing energy and water efficiency and other utility-related improvements. Customers may apply for a loan through the Program via Colorado Springs Utilities’ partnership with a local financial institution. Financing is not directly obtained from Colorado Springs Utilities. Payment for Work Performed
The customer has a direct contractual relationship with the contractor who performs the work financed by the Program. The customer will be responsible for direct payment to the contractor for the work financed through the Program. Contractor’s Responsibilities for Work Performed
The contractor performing the work financed through the Program is responsible for performing the work in a professional manner consistent with industry standards. All contractors offering the Program have been approved by Colorado Springs Utilities to offer the Program to customers. All approved contractors have agreed to resolve customer complaints through the Better Business Bureau of the Pikes Peak Region. Customers are advised to use their own usual methods for retaining a contractor to perform work in their premises; i.e. checking references, written estimates, contacting the Better Business Bureau, etc. Right of Inspection
By obtaining financing through the Program, the customer authorizes Colorado Springs Utilities to inspect the work for which financing through the Program was received within twelve (12) months of the date of completion of the work by the contractor. Colorado Springs Utilities will conduct inspections to assure the contractor performed the work to required standards and to ensure the customer used the loan proceeds for installation of utilities-related home improvements. The customer will be notified in advance of any inspection by Colorado Springs Utilities. Projects for inspection will be randomly selected. Disclaimer of Liability
Colorado Springs Utilities is not responsible for any work performed by the contractor. Colorado Springs Utilities shall not be liable to the customer for personal injury, death or property damage or any consequential, special or incidental damages arising from the contractor’s performance of work for the customer or the failure of the customer to obtain financing through the Program. Colorado Springs Utilities does not guarantee that a customer will be approved for financing through the Program. All loan qualification, processing and underwriting is the responsibility of Colorado Springs Utilities’ Program partner. COLORADO SPRINGS UTILITIES SPECIFICALLY DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Nothing herein shall waive, modify or limit the applicability of the Colorado Governmental Immunity Act to claims brought against Colorado Springs Utilities.
